My boyfriend purchased a truck from West Oaks Auto Plaza with an agreement of a 25,000.00 down payment that would be paid in 3 payments. He paid 2 payments towards the down payment and had a health issue arise in which would cause the 3rd payment to be delayed. As soon as he was able to call and let Dave Ward, the owner of West Oaks Auto Plaza know 3rd payment funds would not be available on date due he did. The truck was picked up the day after payment did not clear the bank. The first payment on the truck was not even due yet and Mr Ward received more than half of down payment. Repeated calls were made to speak with Mr Ward, the owner of West Oaks Auto Plaza who the 25,000.00 down payment in 3 payments agreement was made. Mr Ward has refused all calls as well as chose to not return calls as requested. A copy of the signed contract has been asked for on two separate occasions. The first time he was told it could not be located. The second time he was told to leave an address and Mr Ward's attorney would send it. He left his current home address and has yet to receive a signed contract with signature or a letter from Mr Wards attorney. So it seems in West Oaks Auto Plaza's business practices it is ok to take around 18,000.00 dollars from someone, pickup the truck one day after funds weren't available for the 3rd payment towards the 25,000.00 down payment after receiving well over half of it, refuse to accept calls, not return calls, keep the money given towards the down payment, put the truck back on the lot for sale and deny a copy of the signed contract to the buyer.\r
After exhausting all avenues to work this matter out civilly and as adults there is no other choice or option but to have counsel represent the buyer. Complaints have also been filed with the Houston BBB, The Texas Department of Motor Vehicles, Federal Trade Commission, as well as posting numerous reviews so that other consumers may be aware of the deceptive business practices of West Oaks Auto Plaza and owner Dave Ward.
