To review the timeline, in early April, I met a company representative at my property and we discussed what work I wanted to be done. At that time I expressly said I wanted the TOPS of the fan palms trimmed, the two palm trees trimmed and the beds in the pool area cleaned up from debris. I also EXPRESSLY MENTIONED THAT I DID NOT WANT ANY OF THE BIRDS OF PARADISE TRIMMED, NOR THE BOUGAINVILIA, NOR THE PALMS ON THE SOUTH SIDE OF THE BACKYARD OF THE PROPERTY AS THESE PROVIDE SCREENING FOR THE PROPERTY AND POOL AREA. the company came back to me with a quote on I responded to go ahead with the proposal as written BUT THAT I WANTED TO BE INFORMED WHEN IT WOULD BE SCHEDULED SO I COULD BE PRESENT TO SUPERVISE. I left for a short trip, and returned to find that all of the above work that I had expressly NOT requested had been performed, and the only two palm trees that I had expressly asked to be trimmed were not. The only thing that was done as I had asked was that the mulch was laid. It is not that you did not do work that I had asked you to do and therefore do not want to pay you for it. Rather, it is that you did work that I had expressly asked you NOT to do and now as far as I am concerned you have ruined the landscaping. Unfortunately this may take years to return to the state at which I would find it acceptable. I called your office to talk to the company about the work that was clearly incorrectly done. On Monday a representative visited the property and we discussed the situation. At that time I said that I would pay for the cost of the materials (100 bags of mulch @ $2.33 a bag) but that I felt I should not be responsible for any labor as not only was work not done, but you damaged my property. At that time, the company agreed that what your workmen had done was not what we had discussed, and said that he would come back and finish trimming the two palm trees and deliver bamboo screening for my pool area to replace the greenery that was providing screening. At that time, I said when the two trees were trimmed and the screening was delivered, I would pay for the cost of materials for the mulch. On Wednesday of that week someone from the office and said that they attempted to charge my credit card number they had on file from my regular monthly lawn cutting for $350 and the card was declined. I was shocked that theytried to make an unauthorized charge because this was not what we had discussed. I said I would only pay for materials once the rest of the work had been completed and the screening delivered. The company has yet to do either of these things as discussed. To review, they failed to provide the service I requested by: 1. Not informing me of when the work was to be done so that I could be present to supervise or make other arrangements 2. Did work that was EXPRESSLY NOT REQUESTED and now will take years to return to its former state 3. Did not follow up on their commitment to remedy the situation by trimming the two palm trees and delivering the bamboo screening
