Most unprofessional company ever! They refuse to refund our deposit even though no lease papers were signed and we never moved into the home. The "future" tenants, myself and roomates, are 3 young women. We discovered the area was very dangerous, and decided it would be a bad idea to rent at that property. Homepointe failed to mention anything about the continuation school on the corner and was unsympathetic to our safety. The manager (Sidney) even told us "You are a waste of my time. I have better things to do. I don't want to talk to you anymore or sit here arguing about California State Laws. I'm done. We will not refund your deposit. We are holding it." In California, there is no such thing as a ?non-refundable? security deposit. No matter what it?s called?a key deposit, cleaning fee, move-in fee, closing costs, last month?s rent, etc.?all money you pay in addition to your first month?s rent is refundable. Since ?nonrefundable? deposits are illegal, don?t worry if your rental agreement includes a section about a ?nonrefundable? deposit. This section will not be valid even if you have signed the rental contract or agreed to it. ( www.rentlaw com /dep/cadeposit.htm ) The manager won't return our phone calls, but instead sends us an email stating that they "cannot assess the damages you have caused at this time" therefore they will not be refunding the deposit. The manager also forced US to write out a declaration (since they are so unprofessional they dont have one) stating that we dont want to rent the property anymore, yet he refused to sign it himself. He even refused to sign a paper stating that he refuses to sign any papers that would "hold him liable" (these are his words). NEVER EVER rent from this company! They disregard state laws and unprofessional demeanor make it impossible to work with them. We will be taking further action to get back our deposit. Pros: NO PRO's!!!!! Cons: ILLEGAL BUSINESS FUNCTIONS!!
