Abandoned Contract after 40% of job completed. Removed over $1,000 in job materials that we purchased. Refuses to communicate or complete job. 8/19/2014

Entered into contract June 3, 2014 with Ace Golf to install 2,198 square yards of miniature golf carpet at two locations (Ace Golf Brandon and Ace Golf Riverview) starting 6/22/14 in Brandon and 6/29 in Riverview. Accepted 50% deposit on contract and commenced installation at Ace Golf Brandon. Completed Ace Golf Brandon three weeks after he said he would; left job and returned only after numerous calls. At this point, 40% of job was completed and 60% remained at Ace Golf Riverview. Mr. Berndt then disappeared, taking with him the remaining carpet adhesive that we paid for to be used at Ace Golf Riverview. He never started the Riverview job and would not return calls. Mr. Berndt did not present any objections or complaints to us; he just disappeared and refused to communicate. When our manager finally reached him by posing as a new customer, Mr. Berndt answered his phone, said he was declaring bankruptcy and that he was on a job in Seattle, Washington. We asked him to complete our job at his next available opportunity and even offered to re-negotiate the contract or install dates if there was a problem. Mr. Berndt said he would call back and never did. After several weeks of many calls to his cell phone and many email messages to him, he still does not respond and will not communicate as to why he abandoned our contract. more
