We own a house in Columbia SC, and were forced to move out of Columbia and turn the property into a rental house when we moved. Once the house was rented, we listed Kaminer Heating and Air with our property management company as the emergency contact for HVAC issues (more on that later). Additionally, we entered a service contract with Kaminer to receive HVAC service every six months in early 2010 - the contract terms included a monthly charge of $20. A Kaminer representative arrived in late 2010, and informed us through a phone call that the service for which we had contracted was unavailable to be provided. Somehow, the position of the heating unit was 'impossible' to reach or service. No service was provided, and the $20 a month charges continued. The following spring, a similar call occurred, and a similar lack of service occurred. The monthly $20 charges continued.
The HVAC unit went over 1.5 years without receiving any service. This past summer, (2011) the air conditioning unit failed on the tenants in the property. They called the property manager, who called Kaminer. Kaminer went out to the property, and called me. They said that, due to the lack of service the unit had received, it needed a cleaning that would cost around $1200, and more likely needed the unit to be replaced at an estimate of $6000. The cleaning that was necessary was the same cleaning that was supposed to be provided by the service contract originally entered into in 2010. I declined either of these offers from Kaminer. Kaminer then charged me $99 for the service call, and billed the account associated with the contract without my consent.
I have had NUMEROUS conversations with Kaminer representatives, each time where this chain of events is walked through and an offered resolution is agreed to by the Kaminer rep. I have asked to have the contract annulled, to have the money charged for the months where service was unable to be provided to be refunded, and to have the charges for the service call rescinded. They agree to these terms at the end of the call, hang up, and promise they will call back to confirm the resolution.
However, my account still gets charged, and they haven't provided any meaningful counteroffer or argument. They simply avoid responding and continue to charge me for a service I can't even receive.

As described above, I request the following:
I have asked to have the contract annulled, to have the money charged for the months where service was unable to be provided to be refunded, and to have the charges for the service call rescinded. I am simply asking for a return of the money that I have been charged for services that Kaminer admits they never provided nor could ever provide. I would like to resolve this manner, and not be cheated out of this money.
