without prejudice and based on my opinion,-on may 4 2012 signed a contract to buy truck from j w truck sales ltd. 1998 dodge. I organized the sale and paid IN FULL with my mastercard, for which they charged me extra for that payment. The transaction was authorized with an authorization number from the credit card company done at 10:37 am Saturday May 5, 2012. They sent me copys of the payment slips saturday May 5, 2012. I have bought before using a credit card from other dealers with no problem. Told them we were from Canada and would pick up the truck Monday may 7 2012. Told them we needed all documents and title to get across the border. All was agreed upon with no conditions. We booked the crossing inspection for after 2pm Tuesday May 8th 2012. We drove 850 miles and we were there Monday morning May 7, 2012 to get the truck. They would not give us the truck or title. John Wimpey (owner) said he wanted the money in his bank by Tuesday at noon or the deal was off. He was telling me he had lots of people wanting the truck. I phoned Mastercard Monday and they said the transaction was taken out of my account and sent to their bank on that Monday may 7th. Called Tuesday may 8 morning and they said money was at jw's bank. He said it wasn't and HE SAID the deal was off at noon if he didn't see the money in his account. Noon came and he HE SAID the money was not there and he wasn't giving us the truck. We never did sign a cancellation of the contract. We bought the truck may 5th 2012. It was then advertised $10,880 and after they backed out of our deal they changed it to $12,880. We have the email copy of the signed sales contract, slips from the AUTHORIZED mastercard payment (on May 5, 2012 at 10:37 am.) We are out 5 days, way over $1,000 in gas, rooms, food, etc. We have copys of the truck advertised before and after we made a deal. While we were there I told the manager that they cost us over $1,000 in direct expenses by not giving us the truck. His reply was he was paying $2600 a month in child support and could care less about us losing the money. They accepted my payment without any problem knowing the date we were coming, they gave us an unfair time deadline of Tuesday at noon for them to get their money AFTER we were already there. I told them leave the truck and we would fly down the next week to get it. The owner John Wimpey still said no and the time was still up at noon Tuesday. I feel they breached the contract because they thought they sold the truck too cheap, and forced us to head back to Canada without the truck for which we had a valid PAID IN FULL contract, and for which we paid in full BEFORE we left Canada to pick it up. We are out a lot of money, about 35 hours of driving (approx 1700 miles round trip), 5 days, 4 nights of motel rooms, meals, plus we now have a whole new outlook on southern hospitality and fair business practice by dealing with JW Truck Sales Inc. I dont care what their reply is. They cant argue when I have all the papers, the truck advertized for $10880 before our firm contract and advertized for $12880 after they breached our contract. If feel if I was closer I would sue them. For the rating there was nothing less than 1 star. Should be a 0 at best. Every one outside the truck sale deal were really nice. We met a lot of good honest people down there.
