This customer contracted with us in late 2006 to build them an in ground swimming pool in 2007.We repeatedly left phone messages with their answering machine asking them for certain papers we needed in order to file for the appropriate permits. They did not respond until March of 2007. There were also problems with access to the property. We were told that they had obtained permission for use to use their neighbors side yard as well as to cut down a tree to be replaced later. We talked to the neighbor's wife and she confirmed it was fine. So we hired the digging machine as well as an operator. When it came time dig, however, their neighbors denied access, swearing at us, threatened to take legal action against us, and finally called the police. So we came up with a diffrent way to get the job done,. We would use smaller equipment which would take longer, and would pour using pump trucks at an additional expense. This is necessary occasionally and is also covered in the contract both parties signed. They decided to back out of their contract. We returned 100% of their deposit of $4,000.00 and waived over $1,000.00 we paid in plans, permits, and equipment rentals. I hope this explained what happened. We are a small, three generation, family owned business and do our best to accommodate our customers.
