Our yard is unsafe and unusable because of D&D Mulch & Landscape. In 2009 they sold and delivered to us product that was riddled with debris - glass, asphalt shingles, metals, plastics, tile, grout, screws, nails, etc... etc... They offered to rake, but raking would not adequately remove the debris, as many of the fragments are small - approximately the size of a BB. We were forced to file suit. In June 2012 we prevailed in a jury trial. In August 2012 the MassDEP issued a Notice of Non-Compliance, directing D&D to remove the "soil and entrained solid waste from our yard". Although D&D scraped 5 areas in our yard, a significant amount of visible debris remains in our yard. The lawsuit is now headed to the appeals court. In a baffling move, the MassDEP issued a "Return to Compliance" notice to D&D. That decision is being appealed by us, because of the reasons stated above - our yard is unsafe, and a significant amount of debris is still in our yard. D&D Mulch & Landscape needs to do the right thing and fix our yard.
