These guys are untouchable. You can't find them. They aren't a DBA, LLC, LLP or an INC. How can they expose themselves to such liability? Because they are not sue-able. You can't serve them. You can't even prosecute them because there is nobody to name in the suit! The only recourse you have in finding them is to take pictures of their license plates on the work truck. 2 years ago, it was the same name as the person you wrote your payment checks to. I can't remember the name but the last name was Martinez. He told me that it was a "mexican company that had permission to work in the US"....LOL! Why would a very successful concrete company require that you write your checks out to an individual??? This is why they so eager to tear up your concrete work, if you withhold payment while waiting on them to repair their bad work; because he is scared to prosecute you for non-payment. If he did, he would have to name himself in his suit against you. It is the ultimate game in allowing him to use unskilled labor and get away with it.
